1. Overview

This platform, including chicpiq.com and any corresponding mobile app (collectively, the “Platform”) is operated by ChicPiq (referred to as “ChicPiq,” “we,” “us,” or “our”). These Terms govern your access to the Platform and use of our services, including but not limited to sales, order processing, publishing, or purchasing products, customer support, and interactions with other users.

Your use of the Platform constitutes agreement to be bound by these Terms—including linked policies like the Privacy Policy, Refund Policy, and Cancellation Policy. Continued use after changes to the Terms implies acceptance of those changes.

We may suspend, limit, withdraw, or amend Services at any time without notice or liability.

2. Eligibility & Account Registration

You must be of legal age in your jurisdiction or otherwise have parental/legal consent to create an account.

When registering, you must provide accurate personal information (name, email, address, payment details, etc.), which is subject to our Privacy Policy. You are responsible for maintaining the confidentiality and security of your account. Any activity under your account is your responsibility. In case of unauthorized access or breach, you must notify us immediately.

You may not:

• Provide false or misleading information.
• Share account credentials or allow third-party access.

You may receive communications regarding orders and marketing via email, SMS, or messaging apps.

3. Access & License

We grant you a personal, limited, revocable, non-transferable, non-exclusive license to access and use the Platform and Services, strictly as permitted by these Terms. Any unauthorized use terminates the license.

We may require you to install upgrades, updates, or new versions to continue using the Platform.

4. Subscription or Membership Services (If Applicable)

If we offer paid memberships (e.g., promotional rates), they will be described on the Platform.
Memberships are non-refundable and non-transferable unless otherwise stated. Price changes affect new members only.
We reserve the right to suspend or cancel membership for misuse; in certain cases, refunds may be issued on a prorated basis.

5. Product Information, Orders & Billing

• We strive for accuracy in product descriptions and visuals, but we cannot guarantee exact colour, appearance, or accuracy due to screen differences or human error.
• Prices, availability, and quantities may change without notice; we reserve the right to cancel orders, limit purchases, or modify details at any time.
• You agree to provide truthful and complete billing and account information and keep it up to date. We reserve the right to refuse or cancel orders at our discretion.

6. Prohibited Conduct

You may not use the Platform to:

• Violate any laws or regulations.
• Upload viruses, worms, or malicious code.
• Harass, defame, threaten, or discriminate against others.
• Post false, misleading, or fraudulent content.
• Collect personal data from others without consent.
• Spam, crawl, scrape, or interfere with site functionality.
• Abuse intellectual property. 

7. User Content & Copyright Policy

You retain ownership of your submissions—images, descriptions, reviews, artwork, etc. By submitting content, you grant ChicPiq a perpetual, royalty-free, worldwide, non-exclusive, sub-licensable right to use it.

You agree not to post content that:

• Infringes on the rights of others (copyright, privacy, publicity)
• Is defamatory, obscene, illegal, deceptive, or harmful.
• Contains misinformation, political solicitation, malware, or unauthorized advertising.
• Threatens public safety or national integrity.

We may remove or refuse posts at our discretion. We are not liable for user-generated content or any damages resulting from it.

8. Termination Policy

We may suspend or terminate your access to the Platform or Services at any time, with or without cause, and you may also choose to terminate your use at any time.
Termination does not relieve you of obligations under these Terms (e.g., indemnity, liability exclusions).

9. Disclaimer & Limitation of Liability

The Platform and Services are provided “as is” without warranties or guarantees. To the fullest extent permitted by law, ChicPiq is not liable for any direct, indirect, incidental, punitive, or consequential damages, including lost profits or data.

If permitted by applicable law, our maximum liability to you shall not exceed the total amount paid by you to us in connection with the specific service at issue.

Any claim or action arising from your use of the Platform must be brought within one year from when the issue arose or be barred.

10. Indemnity

You agree to indemnify and hold ChicPiq and its officers, affiliates, employees, and licensors harmless from any claims, liabilities, damages, and expenses arising out of your breach of these Terms, violation of law, or misuse of the Platform.

11. Intellectual Property

ChicPiq retains all intellectual property rights to the Platform, content, design, technology, and documentation. You are granted no ownership or trademark rights.
Any use of ChicPiq’s trademarks requires prior written consent and adherence to our guidelines.

12. Force Majeure

We are not liable for delays or failures due to causes beyond our reasonable control, including natural disasters, civil unrest, cyberattacks, legal changes, or system failures.

 

13. Assignment

ChicPiq may assign or transfer its rights and obligations under these Terms at our discretion. You may not assign your rights or obligations without our written consent.

14. Severability & Waiver

If any provision is deemed invalid, the remainder of the Terms remains enforceable.
Our failure to enforce any right is not a waiver of that right.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of India, without regard to conflict-of-law provisions.
All disputes shall be resolved in courts in, to which both parties submit jurisdiction.

16. Additional Policies

• Privacy Policy governs collection and use of personal data.
• Refund & Cancellation Policies apply to returns and subscriptions.
